LX INDIA – Terms of Use

These Terms of Use ("Agreement”) set forth the terms and conditions governing your access to and use of the services made available through the LX INDIA platform and constitute a legally binding contract between you (hereinafter referred to as the "user”, "buyer”, "customer”, "you”, or "your”, meaning any natural or legal person who registers on the Platform as a registered user by providing the required details), and Levelx Micro Systemes Private Limited (hereinafter referred to as "LX INDIA”, "we”, "us”, or "our”).

By completing the registration process, or by accessing or using any services provided by LX INDIA, you expressly acknowledge, agree, and undertake to be legally bound by all provisions of this Agreement, including, without limitation, any applicable service terms, program policies, and platform rules that govern specific services or features you register for or use in connection with the LX INDIA platform. For the purposes of interpretation, the terms "we”, "us”, and "LX INDIA” shall refer to the LX INDIA entity identified in the applicable service terms.

Registration

Access to, and use of, the LX INDIA Platform and its associated services is strictly limited to individuals and entities who are legally competent to enter into binding contracts under the Indian Contract Act, 1872.

Persons who are deemed "incompetent to contract” within the meaning of the meaning of the said Act— including, without limitation, minors, undischarged insolvents, and persons of unsound mind — are expressly prohibited from accessing, using, registering on, or transacting through the Platform in any capacity.

Without limiting the generality of the foregoing, any individual who has not attained the age of eighteen (18) years shall be ineligible to register as a user, create an account, or conduct any transaction on the Platform.

Should it come to the knowledge of us whether through disclosure, verification, discovery, or otherwise, that a user is under eighteen (18) years of age or otherwise is not legally competent to contract, LX INDIA reserves the right to immediately terminate such registration, cancel any pending transactions, and deny or restrict such user’s access to the Platform, with or without prior notice.

Your LX INDIA Account

1. Account Creation

To purchase products on LX INDIA, you must create an account by providing the information requested at the time of registration, which may include your name, phone number, email address, and delivery details. You agree to provide information that is true, accurate, complete, and up to date at all times.

Your account must represent your real identity. You shall not create an account using false information, impersonate any person or entity, or misuse another person’s identity or contact details. You are responsible for promptly updating your account information whenever any of your personal or contact details change, to ensure correct communication and timely delivery of orders.

2. Account Security

You are solely responsible for maintaining the confidentiality of your account credentials (including passwords, OTPs, and any other authentication details) and for all activity carried out through your account. Any actions performed using your account shall be deemed to have been authorised by you.

If you become aware of any unauthorised access, security breach, suspicious activity, or misuse of your account, you must notify LX INDIA immediately and cooperate with any verification or investigation required to protect the Platform and its users.

LX INDIA shall not be liable for any loss or damage arising from your failure to secure your account, or from unauthorised use of your account caused by your negligence or failure to maintain confidentiality of login credentials.

3. Account Suspension / Termination

LX INDIA reserves the right, at its sole discretion and without liability, to suspend, restrict, or permanently terminate your account (with or without prior notice, as appropriate) if:

• You violate these Terms of Use or any Platform policy;

• You provide false, misleading, incomplete, or inaccurate information;

• You engage in suspicious, abusive, fraudulent, unlawful, or unauthorised activity.

• Your actions may cause harm to other users, sellers, LX INDIA, or the Platform’s integrity; or

• Such action is required to comply with applicable law, a court order, or directions from any governmental or regulatory authority.

Upon suspension or termination, LX INDIA may cancel pending orders, restrict access to Platform features, or take any other steps reasonably required to protect users, sellers, and the Platform.

4. Account Closure

If you wish to stop using the Platform, you may request the closure of your account at any time. However, LX INDIA may process such closure only after completing any pending orders, refunds, returns, chargebacks, disputes, investigations, or compliance requirements.

Privacy

LX INDIA’s collection, use, storage and sharing of personal information is governed by the LX INDIA’s Privacy Policy (as updated from time to time). Our Privacy Policy applies to your use of the Platform and is part of these Terms. By accessing or using the Platform, creating an account, or placing an order, you acknowledge that you have read and understood the Privacy Policy and consent to the handling of your information in accordance with it. You are requested to review our Privacy Policy to understand how LX INDIA collects, uses, shares and safeguards your information.

Use of the Platform

By accessing or using the LX INDIA Platform, you agree to use it only for lawful purposes and in compliance with these Terms and applicable laws.

You must not:

• Provide false, misleading, or incomplete information (including during registration, orders, cancellations, returns, or complaints).

• Impersonate any person/entity or misuse another user’s account.

• Place fraudulent, abusive, or fake orders, or misuse COD, cancellations, returns, replacements, refunds, or chargebacks (including return abuse or returning tampered/used/different items);

• Upload or post unlawful, abusive, obscene, defamatory, harassing, hateful, or infringing content (including reviews and feedback).

• Promote off-platform transactions, competitors, or external links through reviews, Q&A, messages, or any Platform feature.

• Use bots, crawlers, scraping tools, or attempt to interfere with, damage, or gain unauthorised access to the Platform, systems, or data.

Platform Rights

LX INDIA may remove content, cancel transactions, restrict features (including COD/returns/refunds), or suspend/terminate accounts if it reasonably believes there is misuse, fraud, policy violation, or legal non-compliance. Such action may be taken with or without prior notice, depending on the seriousness of the breach.

Product Listings, Prices & Availability

Products displayed on LX INDIA are listed and sold by independent verified sellers. Product information, pricing, and availability are provided by the respective sellers and may change from time to time.

While LX INDIA makes reasonable efforts to ensure that listings are accurate, errors may occasionally occur, including incorrect pricing, stock unavailability, typographical mistakes, or inaccuracies in product descriptions, specifications, images, or other details.

In such cases, LX INDIA and/or the seller reserves the right to:

• Correct or update listing information at any time;

• Cancel or refuse to process an order prior to dispatch/shipping; and

• Issue a full refund if payment has already been made.

You will be notified where required.

Product images are for representation purposes only. Actual product colour, finish, packaging, or appearance may slightly vary due to lighting, screen/display settings, or manufacturer changes.

All prices are shown in Indian Rupees (INR) and include applicable taxes unless explicitly stated otherwise. Offers, discounts, and pricing are subject to change without prior notice based on seller decisions, availability, or market conditions.

Orders and Payments
Placing an Order

When you place an order on LX INDIA, you are submitting a request to purchase the selected product from the relevant seller. An order is considered confirmed only after successful payment and once you receive an order confirmation through email/SMS/Platform notification.

Once confirmed, the seller will process and dispatch the order as per available stock and applicable timelines. You are advised to review all order details carefully (including product specifications, delivery address and contact information) before placing the order, as changes or cancellations may not always be possible after confirmation.

LX INDIA and/or the seller may cancel an order in cases such as stock unavailability, listing/pricing errors, suspected fraud, misuse, or non-compliance with Platform policies, in which case the paid amount (if any) will be refunded as per the Platform’s Refund Procedure.

Payment Methods

LX INDIA supports multiple secure payment options, including Credit/Debit Cards, Net Banking, UPI, Wallets, and Cash on Delivery (COD) for eligible orders.

All online payments are processed through trusted, PCI-DSS-compliant payment gateways to ensure your data remains secure. LX INDIA does not store or have access to your complete card details, passwords, or CVV numbers. For COD orders, payment must be made in full to the delivery partner at the time of delivery. Failure to do so may result in account restrictions or order cancellation. Repeated refusal to accept COD orders, non-payment, or suspicious activity may result in order cancellation and restrictions on COD or account access.

Failed Transactions

If your payment fails but your bank account has been debited, the amount is generally reversed by your bank or payment provider and credited back to you within the timelines prescribed by them (typically within 5–7 business days).

If you do not receive the refund within the expected timeframe, you may contact your bank/payment provider or raise a support request with LX INDIA through the help section for assistance.

Shipping, Delivery, and Tracking

LX INDIA delivers orders through verified logistics partners. Sellers dispatch orders only through courier partners approved by LX INDIA. Once an order is handed over for delivery, tracking details will be shared on your order page.

Delivery timelines shown on the Platform are estimates and may vary due to factors such as seller location, delivery address, service availability, weather conditions, regional restrictions, or other circumstances beyond reasonable control (e.g., extreme weather or government restrictions).

If delivery fails due to customer unavailability or repeated failed attempts, the order may be returned to the seller (Return-to-Origin / RTO) and handled as per LX INDIA’s Cancellation / Return / Refund Policy.

For detailed terms relating to shipping, tracking, delivery attempts, and RTO, please refer to LX INDIA’s Shipping & Delivery Policy, which applies to all orders placed on the Platform.

Returns, Replacements Cancellation & Refunds

LX INDIA aims to ensure a fair and transparent process for cancellations, returns, replacements and refunds for purchases made on the Platform. However, since LX INDIA operates as a marketplace, such requests are processed based on product eligibility, verification outcomes, logistics feasibility, and applicable Platform procedures.

All cancellations, returns, replacements and refunds for orders placed on the Platform shall be governed exclusively by LX INDIA’s Return, Replacement, Refund & Cancellation Policy (as updated from time to time). The Return Policy forms an integral part of these Terms of Use and is incorporated herein by reference.

By placing an order on the Platform, you expressly acknowledge and agree that you have read, understood and accepted the Return Policy, including its eligibility conditions, timelines, verification requirements, non-returnable categories, and exclusions. You agree to comply with all procedures and documentation requirements prescribed under the Return Policy for raising and processing any claim.

LX INDIA may, based on internal verification and Platform processes, accept, reject, limit or modify any request for cancellation, return, replacement or refund, including where (i) the request does not meet the eligibility requirements, (ii) supporting evidence is insufficient, (iii) the product fails verification checks, or (iv) the request appears to involve misuse or abuse of the Platform’s policies.

Sellers and Product Responsibility

LX INDIA operates solely as a marketplace/intermediary platform that connects buyers with independent third-party sellers. Unless expressly stated otherwise, LX INDIA is not the manufacturer, owner, distributor or seller of products listed on the Platform and does not take title to such products.

Each seller is solely responsible for ensuring that products listed and supplied by them are genuine, legally compliant and safe, and that all applicable statutory requirements are met. Sellers are also responsible for accurate product listings, packaging, dispatch, delivery, invoicing, warranties (if any), installation/support (where applicable) and after-sales service.

LX INDIA does not independently evaluate or guarantee product performance or suitability. Buyers are encouraged to review the product description and applicable warranty terms provided by the seller or manufacturer before purchase.

Where a buyer reports an issue, LX INDIA may provide facilitation support; however, resolution remains the responsibility of the relevant seller/manufacturer and shall be governed by applicable policies and law.

Product Warranty

Certain products listed on the Platform may carry a manufacturer’s or seller’s warranty, as specified on the relevant product page. Unless expressly stated otherwise, any warranty period shall begin only from the date the product is successfully delivered to the buyer. Warranty coverage, duration and claim conditions are determined solely by the respective manufacturer’s or seller’s warranty policy.

Buyers may claim warranty services directly through the concerned brand’s authorised service centre, warranty portal or support channel, as applicable. LX INDIA does not provide any product warranty and is not a party to any warranty arrangement, unless the product is explicitly identified as "sold and fulfilled by LX INDIA.” Buyers are advised to retain the purchase invoice and original product packaging, as these may be required for warranty verification and claims.

While LX INDIA does not independently provide warranty services, our support team may assist buyers in connecting with the relevant manufacturer or seller and in sharing order-related information for claim facilitation. Any charges relating to warranty repairs, replacement parts, inspection, logistics or service handling shall be governed by the manufacturer’s or seller’s applicable terms and conditions.

Reviews, Ratings & Feedback

LX INDIA allows customers to post reviews, ratings, photos and other feedback to help users make informed purchase decisions and to help sellers improve their products and services.

When submitting any review, rating, comment, image, video or other feedback ("Review Content”), you agree that it must be truthful, relevant and based on your genuine experience with the product or seller, and shared in a respectful manner.

You must not post Review Content that is false or misleading; abusive, threatening, obscene or hateful; contains personal contact details; promotes external websites, referral links or spam; or infringes any rights or violates applicable law.

Review Content may be reviewed and removed if it does not follow these guidelines. Reviews reflect the personal opinions of users and LX INDIA does not independently verify or guarantee the accuracy of all user-submitted content.

By posting Review Content, you permit LX INDIA to display it on the Platform and to use it in LX INDIA communications and promotions (including product pages, banners, emails, advertisements and social media), with attribution to your name/display name where feasible.

Intellectual Property Rights

All content and branding on the LX INDIA Platform — including product page formats, text, images, graphics, icons, videos, software, and the overall design and presentation — is owned by LX INDIA or used under licence and is protected by applicable intellectual property laws. The names "LX INDIA”, the LX INDIA logo, and all related names, logos, marks, slogans, and brand identifiers (including LX INDIA’s official domains and subdomains such as levelxmicro.com, lxindia.com, cx.lxindia.com, and onboarding.lxindia.com) are proprietary assets of LX INDIA and represent LX INDIA’s goodwill; they may not be used, copied or imitated in any manner without LX INDIA’s prior written permission.

You may use the Platform only for personal, non-commercial purposes and in accordance with the applicable laws and Terms, such as browsing and making purchases through authorised channels. Except for such limited use, you must not copy, reproduce, modify, publish, transmit, distribute, sell, license, mirror, scrape, create derivative works from, or otherwise exploit any part of the Platform content or LX INDIA branding for any purpose. You must also not use LX INDIA’s name, marks or design elements in a manner that suggests affiliation, endorsement or association with LX INDIA, including use in advertisements, domain names/sub-domains, social media pages/handles, keywords/metatags, packaging or promotional materials.

Unauthorised use of LX INDIA’s intellectual property may result in account restrictions, suspension or termination, and may invite legal action and consequences as permitted under applicable law.

Account Suspension, Restriction and Termination

LX INDIA may suspend, restrict, limit access to, or permanently terminate a buyer’s account (and/or any associated accounts) if the user violates these Terms, misuses the Platform, provides false or misleading information, or engages in conduct that may cause harm or risk to LX INDIA, sellers, customers, delivery partners or the Platform ecosystem.

Accounts may be restricted or closed for activities including, but not limited to: misuse of reviews, returns, refunds, offers or customer support; fraudulent or suspicious behaviour (such as fake orders, unauthorised transactions, use of stolen payment methods, refund/return abuse or manipulation of discounts); technical abuse (such as hacking attempts, use of bots/automated tools, unauthorised access or security bypass); or abusive, unlawful or offensive conduct towards other users or LX INDIA staff.

Where feasible, LX INDIA may provide prior notice. However, in cases involving fraud, security threats or repeated violations, action may be taken immediately and without notice.

Fair Usage Policy

LX INDIA is committed to providing a safe, fair and reliable shopping experience for all users on the Platform. To maintain Platform integrity and prevent misuse, LX INDIA may review usage patterns and account behaviour, including order history, cancellations, delivery acceptance/refusals, return and refund activity, claim frequency, and other account-level indicators relevant to customer support and risk control.

If LX INDIA detects behaviour that appears excessive, abnormal, or inconsistent with typical customer usage — including, without limitation, repeated refusal to accept shipments, unusually high levels of returns, repetitive cancellations, abnormal claim activity, or conduct indicating misuse of offers, refunds, or Platform services — LX INDIA may apply appropriate controls to protect sellers, delivery partners and other users.

Depending on the nature and frequency of such behaviour, LX INDIA may take one or more actions, including: limiting access to certain features or benefits; restricting transactions; discontinuing Cash-on-Delivery (COD) for the account; blocking COD orders or COD payments; placing refund or claim requests under review; or temporarily or permanently preventing the user from transacting on the Platform. These measures may be implemented with or without prior notice and may extend to linked or associated accounts where necessary.

DISCLAIMER

You acknowledge that you use the LX INDIA Platform and make purchases at your own choice. LX INDIA is a marketplace that connects buyers with independent sellers and, unless clearly stated otherwise, LX INDIA is not the manufacturer or seller of products listed on the Platform. Product details, warranties and after-sales service are provided by the seller and/or manufacturer.

LX INDIA does not control and is not responsible for the actions, omissions, representations or warranties of sellers or manufacturers, including in relation to product quality, performance, durability, compatibility, pricing, delivery, safety, legality, warranty service or post-sale support. The contract of sale for products listed on the Platform is entered into solely between the buyer and the seller, and no right, title or interest in such products vests with LX INDIA at any stage, unless the product is expressly identified as sold by LX INDIA.

While LX INDIA may provide support to facilitate communication and share order-related information, LX INDIA does not guarantee any outcome or resolution between buyers and sellers/manufacturers. To the maximum extent permitted by law, the Platform and all content and services available through it are provided on an "AS IS” and "AS AVAILABLE” basis, without warranties of any kind, whether express or implied.

Limitation of Liability

To the maximum extent permitted under applicable law, LX INDIA shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or relating to your access to, use of, or inability to use the Platform, including delays, service interruptions, unauthorised access, security incidents, or the acts or omissions of third-party sellers, logistics partners, or payment service providers. You acknowledge that LX INDIA operates only as an intermediary marketplace connecting buyers and independent sellers and does not control or guarantee seller performance unless expressly stated. In any event, LX INDIA’s total aggregate liability for any claim relating to a specific order shall not exceed the total amount actually paid by you for that order.

Indemnification

You agree to indemnify, defend and hold harmless LX INDIA, its affiliates and their respective directors, officers, employees, agents, representatives, successors and assigns from and against any claims, demands, actions, proceedings, liabilities, losses, damages, penalties, costs and expenses arising out of or relating to:

(a) Your use of the Platform, including any misuse of Platform features.

(b) Any breach of these Terms of Use or applicable LX INDIA policies by you.

(c) Any violation of applicable law or third-party rights (including intellectual property, privacy or data protection rights).

(d) Any content posted or shared by you on the Platform, including reviews, ratings, messages or feedback, including claims of defamation, misrepresentation, infringement, invasion of privacy or other proprietary rights; or

(e) Any fraudulent, unauthorised or suspicious activity carried out through your account.

The obligations under this indemnity shall continue to apply notwithstanding suspension, termination or expiry of these Terms.

Entire Agreement

These Terms of Use, together with the policies and notices published on the Platform from time to time, constitute the complete agreement between you and LX INDIA relating to your use of the Platform and Services, and replace any prior versions, discussions or arrangements on the same subject.

If LX INDIA delays or does not enforce any right under these Terms, it does not mean that right is waived. Any unclear provision will be interpreted reasonably and will not be interpreted against LX INDIA simply because LX INDIA drafted these Terms.

Force Majeure

LX INDIA will not be held responsible for any delay, interruption or failure in providing services or completing any obligation under these Terms if it is caused by circumstances beyond our reasonable control. Such events may include natural disasters (such as floods, earthquakes or storms), fire, pandemics or public health emergencies, war or civil unrest, government restrictions or orders, strikes or labour disruptions, internet or telecom failures, payment gateway or bank server issues, cyber-attacks, technical/system failures, or disruptions in transportation, logistics or delivery services.

In such situations, certain services on the Platform may be temporarily affected, and LX INDIA will restore normal operations as soon as reasonably possible.

Severability

If any part of these Terms is found to be invalid, illegal or not enforceable under law, that part alone will be treated as removed or changed as necessary and the remaining parts of these Terms will continue to apply fully and will remain binding on you and LX INDIA. This ensures that the Terms still work and remain effective even if one portion cannot be enforced.

Governing Law And Jurisdiction

This terms of use shall be construed in accordance with the applicable laws of India. The Courts at Mavelikara, Kerala, India shall have exclusive jurisdiction in any proceedings arising out of this agreement.
